Cerebral palsy and Erb's palsy are two of the most common yet serious birth injuries that may result from medical malpractice. However, other problems can also occur during birth. For example, fracture of long bones as a result of a forcible delivery; facial palsy (paralysis of the facial nerve) and even a skull fracture may be caused by an excessivey traumatic delivery.

In some circumstances the baby may die soon after birth or even be stillborn as a result of medical malpractice.

Also certain maternal infections, if unrecognized or untreated, can result in substantial harm to the newborn. For instance, if the mother has Strep B and doctor fails to properly treat it prior to delivery, the newborn may become infected. This can result in brain damage. If a mother's amniotic fluid becomes infected (sometimes because her waters prematurely ruptures) and doctor fails to treat her properly or timely deliver the baby, serious infections can result. These infections in the newborn can cause brain damage and cerebral palsy.

Another well known cause of complications and injury during delivery is gestational diabetes - when the mother becomes diabetic during the pregnancy. This can cause the baby to become too big (particularly in the shoulder area) causing the baby to become unable to safely pass through the birth canal naturally. Occasionally doctors fail to foresee this problem and attempt to deliver the baby vaginally. This can rsult in a traumatic delivery, fetal distress, cerebral palsy and Erb's palsy.

Not all birth related injuries occur to the babies. Sometimes mothers are the ones to get hurt. Although advances in modern medical technology make it rare for women to die during child birth, child birth is still a traumatic event for both the mother and child. Teenagers and middle aged moms are particularly susceptible to complications during pregnancy and child birth.

A condition called pre-eclampsia or eclampsia (pregnancy-induced hypertension) can lead to serious complications for both the mother and child. If left untreated, it can be fatal or cause terrible injuries, such as a brain hemmorhage in the mother. This type of injury maybe the result of medical malpractice, and may have been avoidable through proper medical care.
